Executors

Choosing your executors is vital, as these individuals will be the ones in charge of dividing up our assets. They will be responsible for carrying out the instructions left in your will, so it’s important that you choose someone who you trust and can rely on.


What Are My Assets?

You will need a thorough and complete inventory of your assets when it comes to writing your will. Property, jewellery, vehicles, artwork, personal belongings, investments, you name it! Identifying all your assets will help you to divide up your belongings effectively, and help you avoid missing anything important.


Naming Beneficiaries

It’s vital that you name all your beneficiaries and who will inherit what. By being clear about this in your will, the chance of arguments and disagreements goes away, making the dividing of assets much simpler.


Guardians

If you have minor children, appointing a guardian is a key thing to include in your will. Be sure to choose people that you trust, and outline this in your will clearly, alongside any other wishes for your children’s upbringing.

If you have pets that you want to be cared for after you pass away, you should state this in your will. All details, concerns and wishes matter, no matter how big or small they might seem.


Asset Distribution

You should clearly outline HOW you want your assets to be distributed as well as to who. Be as clear as possible, and do not leave room for interpretation. This can lead to confusion, disagreements and the wrong assets going to the wrong individuals.


Debts & Taxes

If you have any unpaid debts or taxes, identify in your will how you would like to pay these outstanding debts. Usually, a bank account is identified to be used to pay these debts or taxes.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong.
