How Do I Know When I Need a Divorce Lawyer?

Almy & Thomas Solicitors • 19 July 2023

Making the decision to end a marriage is never easy, and the emotional and legal complexities involved can often leave individuals feeling overwhelmed. When facing the prospect of divorce, it's crucial to consider whether hiring a divorce lawyer is necessary. In this blog post, we will explore the key signs and circumstances that indicate when you may need the assistance of a divorce lawyer. Whether it's about understanding your rights, navigating the legal process, or seeking the necessary support during this challenging time, a divorce lawyer can be a valuable asset.

1. When Divorce Issues Become Complex

When your divorce involves complicated issues such as child custody disputes, division of substantial assets, significant debts, or allegations of domestic abuse, it's highly recommended to seek the guidance of a divorce lawyer. These situations often require specialized knowledge and experience to ensure your rights and interests are protected.

2. When You Lack Legal Knowledge

If you're unfamiliar with divorce laws, procedures, and documentation, it's wise to consult with a divorce lawyer. They possess the expertise to guide you through the legal intricacies, helping you understand your rights, obligations, and available options. By having a legal professional by your side, you can make informed decisions and avoid potential pitfalls.

3. Emotional Support and Mediation

Divorce can be an emotionally taxing process, leaving individuals feeling overwhelmed, hurt, and angry. A divorce lawyer not only provides legal guidance but can also offer emotional support during this challenging time. They can act as a neutral third party and help facilitate effective communication and mediation between you and your spouse, ultimately aiming for a fair and amicable resolution.

4. Protecting Your Interests

If your spouse has hired a divorce lawyer, it's crucial to level the playing field. Having legal representation ensures that your rights and interests are protected and that you receive a fair settlement. A skilled divorce lawyer can negotiate on your behalf, advocate for your needs, and help secure the best possible outcome.

5. Complexity of Financial Matters

Divorce often involves complex financial considerations, including the division of assets, property, debts, and determining spousal support or alimony. A divorce lawyer can analyze your financial situation, work with financial experts if necessary, and help you navigate these intricate matters to achieve a fair and equitable settlement.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
