Almy and Thomas Solicitors • 21 September 2022

A personal injury can occur at any time in any place, and can often have a big impact on your life, whether the accident is your fault or not. Most of the time it can result in a loss of income, or have a permanent impact on your life that will affect your body or mind going forward. That is why many people seek to make a personal injury claim when in this situation, to ease the burden and the impact on their life.

Here at Almy & Thomas, we can help with your accident and personal injury claims, helping you to get the compensation you are entitled to. Here is more on how to make a personal injury claim.

Types Of Claim

You can get compensation for your injury by making a claim, but before that, there are a few options which are typically cheaper and take less effort. Making an official complaint asking for compensation may work, or you can use a mediation service to help negotiate a settlement.

If these do not work and you want to take it further, you should make a personal injury claim.

Consider Time Limits

Many people um and ah about whether to put in a personal injury claim and like most legal matters, the longer you wait, the less likely your case will be a success. If you want to make a claim, you should consider seeking legal advice as soon as you can. The most common personal injury claim is due to negligence, and that has a 3-year time limit that starts when you are first aware that you have suffered an injury.

Find Representation

You will normally need to find some legal representation for a personal injury claim, so you should be looking to find a personal injury lawyer to work with you on your case. This can be quite pricey to afford, but luckily costs can be covered using an insurance policy or a conditional fee agreement. This is where your solicitor will receive no fees if you lose your case and if you win, their fees will normally be paid by the other side.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
