Almy & Thomas Solicitors • 18 October 2023

Divorce or separation can be an emotionally stressful and challenging time for anyone, especially if your children are involved. These situations tend to bring up bad feelings, which can make it difficult for families to cope and move forward. However, it doesn’t have to be this way. Our guide is designed to help you support your children through this challenging time in the best way possible. To find out more, keep on reading!

The Best Ways To Support Your Children

These are some of the best ways to support your children through this difficult time.

Listening

Listening to your children and having an honest, open line of communication can really help your family during this time. It’s important for you to understand how your children are feeling and it is healthy for them to be able to talk to you about their feelings or concerns. Being actively listened to can help to make them feel more secure and reassured about the situation. Making them feel safe in such a stressful time is vital to helping them cope in a healthy manner.

Reassurance

Reminding your children that they are still loved by both parents and that the separation is not their fault is really important. They may be feeling confused or down about the situation and giving them some reassurance could go a long way. Reminding them that they are loved and valued can also help with their self-esteem and daily life going forward.

Routine

Maintaining routine in your children’s lives is important for a range of reasons. A divorce or separation can seem like a big life change, so keeping school and mealtimes the way they always have been is a good way to remind your children that everything is okay. Maintaining routine can also help your children by making them feel more confident, secure and in control of their environment.

Don’t Bad Mouth Your Former Partner

It’s really important that you don’t speak negatively of your ex-partner in front of your children. They may already feel confused about the situation and hearing one parent speak badly of the other may only confuse them further. Keeping things civil between you and your ex-partner in front of your children is crucial for maintaining a more healthy dynamic.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
