Divorce can be a stressful and expensive process. However, when spouses are divorcing amicably, sharing a divorce lawyer for a collaborative divorce can facilitate the process and be advantageous for both parties.

Read on to learn more about the benefits of sharing the same divorce lawyer during the divorce process.

Cost-Effective Solution

One of the most compelling reasons for couples to share a divorce lawyer is the potential cost savings. Divorce can be financially draining, with each party typically hiring a separate attorney and incurring separate legal fees. By opting for a single divorce solicitor, the couple can significantly reduce these expenses.

Time-Saving Process

In addition to being cost-effective, sharing a divorce lawyer can expedite the divorce process. When each spouse has their own lawyer, there can be delays due to the back-and-forth communication between the attorneys. With a single divorce solicitor, the process is streamlined, leading to quicker resolution of legal matters.

Cooperative Approach

Sharing a lawyer encourages a more cooperative and amicable approach. The role of a shared divorce solicitor is to facilitate negotiations and help both parties reach mutually acceptable agreements, rather than pitting them against each other. This collaborative approach is especially important if children are involved.

Simplified Communication

Having a single point of contact for legal matters simplifies communication. Both parties can communicate directly with the same lawyer, ensuring that information is accurately conveyed and reducing the risk of misunderstandings.

Mutual Decision-Making

Sharing a lawyer encourages both parties to actively participate in decision-making processes. The divorce solicitor can provide unbiased legal advice, helping the couple work together to reach agreements on important issues such as asset division, child custody, and support arrangements. This collaborative decision-making can lead to more satisfactory outcomes for both parties, as they have a say in the final agreements.

Efficient Resolution

The streamlined process of sharing a divorce lawyer can lead to a quicker and more efficient resolution. Without the delays caused by coordinating between two separate legal teams, the couple can finalise their divorce more swiftly. This enables both parties to move on with their lives sooner and begin the next chapter with less lingering legal entanglement.

Tailored Solutions

Finally, a shared lawyer can help create customised solutions that consider the needs and interests of both parties. Unlike the adversarial approach, where each lawyer advocates for their client’s interests, a single divorce lawyer can focus on finding balanced solutions that work for both spouses. This tailored approach can lead to more creative and flexible agreements that better suit the couple's unique situation.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
