The Do’s and Don’ts of Filing a Personal Injury Claim

Almy & Thomas • 25 January 2023

If you have recently suffered an injury that is through no fault of your own, then there is the opportunity for you to file a personal injury claim in order to gain some compensation. No matter the injury, experiencing an accident can be an extremely stressful and painful experience. Whether you’re seeking compensation for lost earnings, cost of medical bills or because of the negative impact on your physical and mental health, there are certain things you need to consider when filing a personal injury claim. Personal injury claims can be extremely intricate and complex, and it can be difficult to know where to start and how to build the best case possible. Luckily, this guide will help to explain what you should and shouldn’t do when filing a personal injury claim.

From seeking legal assistance from personal injury solicitors to gathering evidence, take a look at our do’s and don’ts of filing a personal injury claim.

Do This:

●     Seek Legal Assistance - As aforementioned, personal injury claims can be extremely complex, making it extremely difficult to navigate without the necessary knowledge and experience. Whether you’ve had an accident at work or been injured in a car accident, you should contact a personal injury solicitor at the earliest opportunity. These solicitors will be able to give you advice on what steps you need to take to build the best case possible.

●     Gather Evidence - One of the most effective ways to build a strong personal injury claim is to gather evidence. Without any evidence, it can be difficult to show the extent of the injury or how the accident may have taken place. The more evidence your personal injury solicitor has, the stronger your claim will be.

Don’t Do This:

●     Make The Case Public - When attempting to file a personal injury claim, it is absolutely integral that you keep it between yourself and your solicitor. If you have taken photos for evidence, then it’s critical that it is kept between you and your solicitor and not shared anywhere else. Making your claim public on social media or giving statements to insurance company representatives will only weaken your claim.

●     Ignore Your Health - Whilst it is important to make a successful claim, your health should always be a priority. If you have been instructed to rest and recover by your doctor, then you should abide by their instructions. If you have been given medication to help recover, then it’s paramount that you follow their orders.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
