Readers will recall our commentary regarding the
introduction of the new Divorce Law in April of this year. On analysis
there is potential for both husband and wife to jointly issue their own
petition. We believe that this creates a significant potential conflict
of interest for Solicitors, and we will not accept instructions to issue a
joint petition. There is no practical benefit in doing so in any event.
Whilst writing this Blog, readers will note that legislation is in place so that the legal age for marriage and civil partnership requires that you be 18 years of age before you can marry or enter into a civil partnership. It is ironic that the legislature impose that requirement when we have issues in this day and age as to when a young person can chose their sexual identity and ultimately transition well before their 18th birthday. Some of you may review this as contradictory, we cannot comment.
