Writing a will is a crucial step to ensure your wishes are respected and your loved ones are cared for after your passing. Here at Almy & Thomas Solicitors in Torquay, we provide expert assistance in will writing, making the process straightforward and stress-free.

Here are some essential tips for writing a will, highlighting the benefits of seeking professional help from the team here.

Understand the Importance of a Will

A will is not just a legal document; it is a vital tool for ensuring your wishes are followed, providing for your loved ones, and avoiding disputes. Clearly stating how your assets should be distributed ensures that your intentions are respected, and naming guardians for minor children provides them with the security they need.

Gather Necessary Information

Before meeting with your solicitor, prepare details like your full name and address, marital status, information on your children and dependents, and a comprehensive list of your assets and liabilities. This preparation will make the process smoother and more efficient.

Choose the Right Executors

Executors are responsible for carrying out your will. Choose someone reliable and capable of handling financial matters. Ensure they are willing to take on the responsibility and preferably live nearby to manage the tasks involved efficiently.

Decide on Guardians for Minor Children

If you have children under 18, appointing a guardian is essential. Discuss this with potential guardians to ensure they are willing and able to take on the role. Include detailed instructions on how you want your children to be raised, covering education and healthcare preferences.

Address Inheritance Tax

Inheritance tax can significantly impact your estate. Almy & Thomas can assist in minimising tax liability through strategies like setting up trusts and keeping you informed about the latest laws affecting inheritance tax.

Review and Update Your Will Regularly

Life changes, and so should your will. Regularly update it to reflect changes in your assets, family circumstances, and legal regulations. This ensures that your will remains accurate and enforceable.

Seek Professional Help

While DIY wills are an option, professional solicitors ensure your will is legally binding and comprehensive. Almy & Thomas offers personalised service, tailored advice, expert knowledge, and peace of mind that your will is properly drafted and executed.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
