5 Things You Need to Know About Property Conveyancing

Almy & Thomas Solicitors • 18 May 2023

Buying or selling a property is a significant financial decision that requires careful planning and attention to detail. Property conveyancing is the legal process of transferring property ownership from one party to another, and it can be complicated and time-consuming without the help of a qualified solicitor. In this blog post, we will cover the five things you need to know about property conveyancing to help you navigate the process successfully.

Costs can vary

The cost of property conveyancing varies depending on several factors, including the value of the property, the complexity of the transaction, and the location. It is essential to obtain a quote from your solicitor and ensure that all costs are transparent and clearly outlined in advance. In addition, it is crucial to factor in any additional costs, such as stamp duty, search fees, and land registry fees, when budgeting for your property transaction.

Searches are an essential part of conveyancing

Before completing a property transaction, solicitors will conduct searches to ensure that there are no legal issues or liabilities associated with the property. These searches may include checking local authority records, environmental searches, and water and drainage searches. Searches are a vital part of the conveyancing process, as they help identify any potential issues with the property, such as boundary disputes or planning restrictions, that may impact your decision to proceed with the transaction.

The process can take time

Property conveyancing can be a time-consuming process, and it is essential to be patient and allow enough time to complete all the necessary legal requirements. The average property conveyancing transaction takes between eight and twelve weeks to complete, but this can vary depending on the complexity of the transaction and any issues that arise during the process. It is crucial to keep in regular contact with your solicitor and be prepared to be flexible with timelines to ensure a successful outcome.

Communication is key

Effective communication between all parties involved in a property transaction is crucial to ensuring a smooth and successful outcome. Solicitors play a vital role in facilitating communication between the buyer, seller, estate agent, and other parties involved in the transaction. It is essential to keep in regular contact with your solicitor, ask questions when you are unsure about any aspect of the process, and be open and transparent about your expectations and requirements.

Solicitors are a must-have

Property conveyancing involves various legal requirements, including title searches, contract drafting, and property registration. As such, it is essential to have a qualified solicitor to guide you through the process. Solicitors will ensure that all legal documents are correctly prepared, identify any legal issues that may arise, and liaise with other parties involved in the transaction on your behalf.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
