Why Hire a Solicitor for Your Personal Injury Claim

Almy & Thomas Solicitors • 21 June 2023

If you have suffered an injury that wasn’t your fault, it can cause a lot of stress in your life, on top of the pain you are already dealing with. Whether your injury happened at the workplace or in a public space, it’s important you receive the compensation you deserve in order to recover and get back to your daily life.

You may feel like you don’t need to contact a solicitor for your personal injury claim, but there are many reasons why doing so can be very beneficial for you. From understanding the legal process to knowing how much your claim is worth, personal injury claims can be challenging, but solicitors are here to help.

Here’s why you should consider hiring a solicitor for your personal injury claim.

Improve Your Chances

When facing a personal injury claim you will be going head-to-head with an insurance company. They can be intimidating and they have much more experience and knowledge than you do when it comes to winning against a claim. Rather than going in underprepared, hiring a solicitor will increase your odds of winning your claim and getting the compensation you deserve.

They Want You to Win

Solicitors often don’t get paid unless they win the case so they are much more motivated to help you win than the insurance company is. Not only do they want you to get the best possible outcome, but they are also more inclined to help you win in order to gain compensation for their law firm. By hiring a solicitor you can feel confident that they want you to receive as much compensation as possible.

They Know How Much Your Claim is Worth

The problem with not having the support of a solicitor is that you may not know how much compensation you really deserve and could end up leaving with less than you could if you hired a solicitor. An experienced solicitor will understand the details of your case and know exactly how to handle the insurance companies to make sure you are not left short-changed.

They Understand the Legal Process

The main problem with not hiring a professional is that you may not be able to handle the legal process of claiming compensation for a personal injury. Solicitors know all the ins and outs of personal injury claims as they will have dealt with many during their careers. Personal injury claims require lots of admin, filing documents and completing forms and it is often easier to leave it to the professionals who have years of experience behind them.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
