Conveyancing Tips: A Guide to Smooth Property Transactions

Almy & Thomas Solicitors • 17 August 2023

Conveyancing is a crucial process when buying or selling a property. It involves the legal transfer of ownership from the seller to the buyer. To ensure a smooth and successful transaction, it is important to be aware of some essential conveyancing tips. In this blog, we will explore five key tips to help you navigate through the conveyancing process.

Engage a professional conveyancer or solicitor

One of the first and most important steps in the conveyancing process is to engage a professional conveyancer or solicitor. They will handle all the legal aspects of the transaction, ensuring that all necessary documents are drafted, reviewed, and signed correctly. A competent conveyancer will also conduct thorough searches to uncover any potential issues, such as outstanding debts or disputes, that may affect the property's title. Their expertise will provide you with peace of mind and protect your interests throughout the entire process.

Obtain a detailed property inspection

Before proceeding with the purchase, it is crucial to conduct a detailed property inspection. Engaging a qualified building inspector will help identify any structural or maintenance issues that may not be immediately apparent. This inspection report will provide you with a comprehensive understanding of the property's condition, allowing you to negotiate repairs or price adjustments if necessary. Remember, a thorough inspection can save you from potential headaches and unexpected costs in the future.

Understand the contract of sale

The contract of sale is a legally binding document that outlines the terms and conditions of the property transaction. To protect yourself, it is essential to read and understand all the clauses and conditions stated in the contract. Pay close attention to details such as the purchase price, included fixtures and fittings, settlement date, and any special conditions. Seek clarification from your conveyancer or solicitor on any ambiguous or confusing clauses to ensure you are fully aware of your rights and obligations as a buyer or seller.

Arrange sufficient finance and insurance

Securing adequate finance and insurance is crucial when buying or selling a property. Before committing to the transaction, ensure that you have obtained pre-approval for your home loan. This will give you a clear understanding of your budget and prevent any last-minute financial hurdles. Additionally, arranging suitable insurance coverage is vital to protect your investment. Comprehensive building and contents insurance should be in place from the moment you exchange contracts, safeguarding you against unforeseen events such as fire, theft, or natural disasters.

Communicate effectively and be proactive

Effective communication is key to a successful conveyancing process. Maintain regular contact with your conveyancer, solicitor, real estate agent, and lender to stay informed about the progress of the transaction. Promptly respond to any requests for information or documentation to avoid delays. Being proactive throughout the process will help identify and address any potential issues early on, preventing complications later. Clear and open communication ensures that all parties involved are on the same page, leading to a smoother and more efficient conveyancing experience.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
