Key Considerations When Filing a Personal Injury Claim

Suffering a personal injury can have far-reaching consequences, both physically and financially. If you find yourself in such a situation, filing a personal injury claim can help you seek compensation and justice. However, it is important to be aware of certain essential factors when navigating the process in the United Kingdom. Read on to learn some key considerations to keep in mind when filing a personal injury claim.

Establish liability

In the UK, to file a successful personal injury claim, you must establish that someone else was responsible for your injury. This could be an individual, a business, or even a public body. Gathering evidence such as witness statements, photographs, and any available CCTV footage will help support your case and prove liability.

Seek medical attention

Seeking prompt medical attention is crucial for your well-being and the success of your claim. Visit a healthcare professional who can assess your injuries and provide necessary treatment. The medical records and reports generated during this process will serve as vital evidence of your injuries and their impact on your life.

Understand the time limit

In the UK, there is a strict time limit within which a personal injury claim must be filed. Generally, this limit is three years from the date of the accident or from the date you became aware of your injury. Failing to file within this timeframe may result in your claim being time-barred. It is crucial to consult with a personal injury solicitor promptly to ensure you meet all necessary deadlines.

Consult with a personal injury solicitor

Engaging the services of a reputable personal injury solicitor is highly recommended when filing a claim in the UK. These legal professionals have the expertise and experience to guide you through the complexities of the process. They will assess the strength of your claim, handle negotiations with insurance companies, and represent your best interests in court, if necessary. Working with a solicitor increases your chances of obtaining the maximum compensation you deserve.

Keep a record of expenses

Maintaining a detailed record of all expenses related to your injury is essential when filing a personal injury claim. This includes medical bills, travel costs, rehabilitation expenses, and any loss of earnings. These records will help establish the financial impact of your injury and form the basis for calculating the compensation you are entitled to.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
