Dispelling Common Personal Injury Myths & Misconceptions

Many people hold misconceptions about personal injury claims and personal injury solicitors that can prevent them from making a claim. However, personal injury claims do not have to be complex, time-consuming or costly - at least not with the right personal injury solicitors.


In this blog, we’ll dispel some of the most common myths and misconceptions about personal injury claims to help you get the compensation you deserve.


You’ll have to go to court

One reason people choose not to claim a personal injury is because they think they’ll have to go to court. In reality, only five per cent of claims end up in front of a judge and these are usually complex cases. Your personal injury solicitor will be working hard to keep your claim out of court and get the right settlement. Even if you do need to go to court, it isn’t as scary as you may think and your solicitor will be with you every step of the way.


Claiming costs a lot of money

You may be concerned at how much a claim will cost and that can put off a lot of people from claiming, especially if they are already out of work. I will be fired or cause my employer to go bankrupt if I claim

There’s no need to worry about losing your job if you claim because it is against the law for your employer to fire you or treat you any differently after compensation. This would count as unfair dismissal or constructive dismissal and would allow an employment tribunal to award you compensation or even order reemployment. Additionally, every employer is legally entitled to have insurance to cover the cost of compensation claims - so they will not be out of pocket.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong.
