Writing a will

It is never easy to deal with the passing of a loved one. If someone passes away, and he or she does not have a will, then it might wind up causing a significant amount of turmoil within his or her family. People can wind up having spats over how the assets of the estate should be distributed. This can be very frustrating and will make dealing with the passing of a beloved family member even more difficult.

For this reason, it is imperative for you to draft a living will as soon as possible. It isn't necessarily a fun topic of conversation, as confronting your own mortality can feel a bit too macabre. Even so, getting the right help to draft a will is going to be important. You can reach out to probate lawyers who can assist you and make the process much easier.

Drafting a Will

Wills need to be written very carefully to ensure that your wishes are carried out properly. Using wording that could be interpreted in multiple ways is going to make your will less effective than it should be. If you sit down with skilled lawyers, then they will be able to give you all of the best legal advice. They understand how to draft a will so that your wishes will be carried out exactly.

You will need to sit down and have a thorough conversation with the lawyers. They can go over the assets of your estate and will ensure that everything is distributed properly. In the event of your passing, your lawyers will enact the will, and your family will have one less thing to worry about. This will allow them to focus on grieving rather than concerning themselves with matters of the estate.

This entire process can be very streamlined and simple when you have the right probate lawyers on your side. They write wills all the time and understand exactly what needs to be done. Even if you aren't sure about what to do, they will be able to guide you through the entire process. It will be a painless experience, and you'll be able to sleep easier knowing that your affairs are settled.

A news items appears in the Daily Telegraph whereby a widower who has been given a life interest in the family home by his Deceased Wife is challenging the limited benefits of that bequest on the basis that he was married to his Wife for a number of years. To the shock and horror of his family he has made a claim for family provision to seek a capital sum from his Wife’s Estate. This is a timely reminder that your last will and testament is definitely not necessarily the case. You need to make provision in your will for those that should be reasonably within your consideration at the time of your death. To effectively deny your surviving spouse gives rise to a claim for at least 50% of the Deceased’s Estate. We are not sure why the family are horrified that their father would make such a claim.

We read with some amusement the recommendation of Martin Lewis to say that a very simple way of mitigating Inheritance Tax is to get married! We are not sure that that dramatic step is the better way of mitigating Inheritance Tax. Our Divorce Department would suggest that it can create as much problems as it solves. The adviser goes on to say that once you have married you can give as much money away as you want without giving rise to a liability for Inheritance Tax. That again is wrong. If you do require advice as to mitigating Inheritance Tax, please contact Mrs. Cotton in our Private Client Department on 01803 299131.
